Westland, Amy

About Me


Amy Westland is Deputy Judge of the Ontario Small
Claims Court for the Toronto Region and presides over civil litigation
proceedings, including settlement conferences, motions with and without notice,
motions in writing, and trials of claims relating to contract, torts, and
labour and employment.



She is Senior Counsel at Westaway Law Group, where she
provides legal and strategic advice to Indigenous groups in litigation and
negotiations. She advises on the development and enforcement of First Nation
legislation and policies that facilitate sustainable economic development,
fiscal transparency, environmental protection, and community safety. In
addition, she negotiates and guides the implementation of governance
agreements, as well as consultation agreements for planned resource
development.



Prior to joining the firm, Ms. Westland worked for the
federal Department of Justice, where for two years she provided legal guidance
and direction to foreign and Canadian authorities prosecuting crimes across
international borders. Prior to this, she provided strategic legal advice and
direction to senior federal litigators, negotiators, and officials on questions
of aboriginal rights and title, treaty rights, and Indigenous self-government.



Before joining the government, Ms. Westland was an
associate at a large national firm, where her practice focused on litigation of
a wide range commercial disputes, shareholder remedies, information technology
and intellectual property law, competition law, and administrative law. She
appeared before the Ontario Court of Appeal, the Superior Court of Justice, and
the Commercial List in Toronto, as well as before various administrative tribunals.



Ms. Westland holds a Certificate in Mediating Disputes
from Harvard Law School's Negotiation Institute. She has a Juris Doctor from
the University of Toronto (2002), and a Bachelor of Commerce (Economics)
(1999).
